18 U.S.C. § 2257 Compliance

Platform status

KinkCoach provides software tools that help adult content creators manage their accounts, schedule posts, operate storefronts, and handle communications across third-party platforms. KinkCoach does not itself produce, publish, or make available any sexually explicit depictions as defined under 18 U.S.C. § 2257 and 28 C.F.R. Part 75.

As a technology platform that does not produce or publish sexually explicit content, KinkCoach is not a primary or secondary producer as defined under § 2257 in respect of any content created or distributed by the creators who use our services.

Creator responsibility

Creators who use KinkCoach tools to manage, publish, or sell content remain solely responsible for their own compliance with all applicable laws in the jurisdictions where they operate, including 18 U.S.C. § 2257 where applicable. This includes:

• Maintaining records verifying the age and identity of every person depicted in their content;
• Ensuring that all persons depicted in their content are 18 years of age or older;
• Displaying a compliant § 2257 statement on any website or platform through which they make explicit content available;
• Cooperating with any lawful inspection of those records.

KinkCoach reserves the right to terminate the account of any creator who fails to maintain compliance with applicable age-verification and records-keeping laws, or whose content involves any person under the age of 18.

Individual creator storefronts

KinkCoach operates a storefront hosting service that allows creators to run their own branded online shops. Each creator storefront is operated by the individual creator, who is responsible for the content displayed on it and for all applicable legal compliance including § 2257 record-keeping. Each storefront displays its own compliance statement.

Reporting concerns

If you have reason to believe that any content accessible via KinkCoach or a creator storefront powered by KinkCoach involves a person under the age of 18, or otherwise violates applicable law, contact us immediately:

Custodian of records

For records maintained in connection with content created or published by creators using KinkCoach-powered storefronts, the custodian of records is the individual creator operating that storefront. Contact information for each creator is available via the contact page of their respective storefront.
